2. Description of Service

imgc AI is an AI-powered image generation service that uses OpenAI's DALL-E 3 technology to create images from text descriptions (prompts). The service includes user account management, image generation, public gallery features, and inspiration browsing.

3. User Accounts

3.1 Authentication

To use certain features, you must sign in using Google OAuth. By signing in, you authorize us to access your basic Google profile information (name, email, and profile picture). You are responsible for maintaining the security of your Google account.

3.2 Eligibility

You must be at least 13 years old to use this service. By creating an account, you represent that you meet this requirement.

3.3 Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may also request account deletion by contacting our support.

4. AI-Generated Content

4.1 Content Ownership

You retain ownership of the text prompts you provide. Images generated through our service are created using OpenAI DALL-E 3 and are subject to OpenAI terms of use. You may use generated images for personal and commercial purposes, subject to applicable laws and OpenAI policies.

4.2 Content License

By generating images, you grant us a non-exclusive license to store, display, and feature your generated images in our public gallery and for promotional purposes. You may opt out of public gallery display.

4.3 Prohibited Content

Content that violates laws or regulations
Content that infringes intellectual property rights
Adult, sexually explicit, or pornographic content
Content depicting violence, gore, or harm
Content promoting discrimination or harassment
Deepfakes or misleading content without disclosure
Content that violates OpenAI usage policies

5. Third-Party Services

Our service uses OpenAI's DALL-E 3 for image generation. Your prompts are transmitted to OpenAI for processing. Your use of this service is also subject to OpenAI's terms of use and usage policies. We are not responsible for the availability or performance of third-party services.

6. Prohibited Conduct

Using the service for illegal purposes
Attempting to bypass content safety filters
Interfering with service operations or other users
Using automated tools without permission (except approved API access)
Reverse engineering the service or underlying models
Impersonating others or creating misleading content

7. Fees and Payment

We offer a free tier with unlimited image generations. Premium features may be offered for a fee. All fees are non-refundable except as required by law or stated in our refund policy. We may offer a 7-day satisfaction guarantee for new subscribers.

8. Intellectual Property

The service, including its original content, design, and functionality, is owned by imgc AI and protected by intellectual property laws. We grant you a limited, non-exclusive license to use the service for personal or commercial purposes in accordance with these Terms.

AI-generated images may not always meet your expectations and may contain errors, artifacts, or unexpected content. We do not guarantee the accuracy or appropriateness of generated content.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Governing Law

These Terms shall be governed by applicable laws. Any disputes shall be resolved through good faith negotiations, and if unsuccessful, through the courts of competent jurisdiction.
